About These Terms

These Terms of Service govern your engagement with HĀM Studio ("HĀM", "we", "us") and apply to all commission inquiries, design services, and product purchases. By submitting a commission brief or placing a deposit, you agree to these terms in full.

The Commission Process

All HĀM pieces are produced on a bespoke, made-to-order basis. The commission process begins with a written brief submitted via our website. Upon review, our design team will confirm project fit and propose a suitable service pathway — The Space Brief, The Spatial Audit, or The Full Commission. Concept renders and design documentation are provided for client approval before fabrication commences. No production work begins until the client has reviewed and confirmed final specifications in writing.

Payment Terms

A commissioning deposit of 50% of the total agreed project fee is required to initiate production. Because bespoke work and project-specific purchasing begin against the approved specification, the deposit is not refundable for a change of mind once that work has commenced, except where a refund or other remedy is required by law. The remaining balance of 50% must be paid in full and cleared before dispatch of the completed piece. HĀM currently accepts bank transfer and PayPal. Each proposal and invoice states the agreed currency and payment schedule. Freight, duties, taxes and installation are itemised or confirmed in the commission agreement where applicable. HĀM reserves the right to withhold dispatch until all amounts due have been received and cleared.

Lead Time & Production

The production and delivery programme for each Full Commission is confirmed in writing after final design approval, receipt of the commissioning deposit, and review of material availability, production complexity, destination and access requirements. The programme is an estimate unless expressly stated otherwise. Client changes, material delays, customs, freight disruption or other circumstances outside HĀM's reasonable control may require a revised programme. Any material change will be communicated in writing. Significant changes to the approved specification may also result in additional costs, which will be confirmed before proceeding.

Shipping & International Freight

Fabrication, packing, freight, delivery and any installation pathway are confirmed for each project and destination before final pricing. Where HĀM arranges freight, the piece is professionally packed and the applicable freight cost is itemised in the project quote or final invoice. Building access, placement, assembly and installation requirements must be disclosed before dispatch and are included only where expressly stated in writing. Customs duties, import taxes and local charges are the client's responsibility unless the project agreement states otherwise. To the extent permitted by law, HĀM is not responsible for delay caused by customs or third-party carriers, but will assist with a documented freight claim where HĀM arranged the shipment.

Made-to-Order Returns & Consumer Rights

Because HĀM pieces are custom-designed and produced to an approved individual specification, we do not accept change-of-mind returns or exchanges. This does not exclude or limit any consumer guarantees, rights or remedies that cannot lawfully be excluded in the country or region where the commission is supplied. If a piece is faulty, materially differs from the approved specification, or arrives damaged, contact studio@byhaam.com promptly with photographs so the appropriate warranty, statutory or freight remedy can be assessed.

10-Year Warranty

Every physical commission whose fabrication HĀM commissions, manages or expressly approves in writing includes a 10-year warranty from delivery against manufacturing and structural defects under normal domestic use. Where a client independently appoints a local fabricator to build from HĀM documentation, that fabricator remains responsible for its materials, workmanship and installation, while HĀM remains responsible for the design services and documentation it provides. Coverage, exclusions and the claim process are summarised at byhaam.com/warranty and recorded in the written warranty supplied with an eligible piece. The warranty operates in addition to any rights and remedies available under applicable consumer law.

Design Ownership & Intellectual Property

All design concepts, renders, drawings, and documentation produced by HĀM Studio remain the intellectual property of HĀM Studio until full payment has been received. Upon receipt of final payment, the client receives a licence to use the completed physical piece. HĀM retains the right to document and photograph all commissions for portfolio, press, and promotional purposes unless the client requests otherwise in writing at the time of inquiry.

Cancellation

If the client cancels after bespoke work or production has commenced, HĀM may retain the commissioning deposit and invoice reasonable additional costs already incurred, except where a refund or other remedy is required by law. Cancellation requests must be submitted in writing to studio@byhaam.com. HĀM will provide a summary of work completed and project-specific costs on request.

Limitation of Liability

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded in the country or region where the commission is supplied. Subject to those non-excludable rights and to the extent permitted by law, HĀM's aggregate liability in connection with a commission is limited to the fees paid for that project, and HĀM is not liable for indirect or consequential loss. HĀM is not responsible for damage caused by misuse, unauthorised modification, unsuitable placement, failure to follow care guidance, or use outside the approved purpose.

Governing Law

These Terms are governed by the laws of New South Wales, Australia. Subject to any non-excludable rights a client may have in another jurisdiction, the courts of New South Wales have jurisdiction in relation to a commission engagement.

Changes to These Terms

HĀM Studio reserves the right to update these Terms of Service at any time. Any changes will be published on this page with a revised effective date. The terms in effect at the time your commission deposit is received shall govern your engagement.
